Why Every Young Family Needs an Estate Plan

If you’re a young parent in Colorado, chances are your days are filled with diaper bags, school drop-offs, figuring out how to entertain your little one during a hike, wrangling the dogs, and wondering how your tiny human already outgrew their shoes that you just spent $55 on. Estate planning probably feels like something you can deal with later. Honestly, I don’t blame you, I had that same thought.

It isn’t about preparing for the worst—it’s about protecting your family while you’re living your fullest, busiest life right now. And for young families, having an estate plan in place is one of the most loving things you can do for your children. I am sure those of you that are parents understand how once you become a parent your priorities instantly shift. The second you hold your child in your arms you go from worrying about yourself to constantly thinking about this human being that you just met seconds ago but have infinite love for.

You will do anything for this child, whether it’s your adrenaline helping you survive on 30 minutes of sleep or you’re singing songs in a weird baby voice, you make sure your child is cared for no matter what and that is exactly what estate planning is about.

As a mom, I started Eomma Law LLC to work with young families across Colorado, to make sure they have everything in place to rest easy at night knowing their family is cared for. Contrary to popular opinion, estate planning isn’t about wealth or worst-case scenarios, it’s about love, responsibility, and peace of mind. It does not have to be overwhelming or expensive, it can be simple, thoughtful, and tailored to your family’s needs.

If something were God forbid to happen to you or your partner, who would take care of your children? Who would make medical decisions on their behalf or decide what school they would go to? A thoughtful estate plan allows you to name guardians for your children, choose who would manage finances on their behalf, and make sure decisions are made by people who know your values and not by a court that doesn’t know you at all. As an attorney, I first handedly know that family matters are always best handled outside of the courtroom because no one knows your family like you do.

So, what would happen if you didn’t have a plan in place? The Court will decide these things for you. Your child could end up with that family member you do not see eye to eye with if that ends up being the only logical choice the court finds. Your child could end up having to move to a State where you never would have wanted them to grow up in or worse, if you do not have family at all, your child can end up in the system. If your children end up in a situation where the Court needs to decide their fate, this can mean delays, added stress, and outcomes that don’t reflect what you would have wanted for your children. With the right estate plan, you have the ability to make decisions ahead of time, so your loved ones and the Court aren’t left guessing what is best and that alone is reason enough to make sure you get on it!
